HORSEBACK RIDING
State of Florida WARNING: UNDER FLORIDA LAW AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES. THIS WARNING COMPLIES WITH THE NOTIFICATION REQUIREMENT FOUND IN SECTION 77.04, FLORIDA STATUTES (1997)
RELEASE OF LIABILITY AND COVENANT NOT TO SUE
I, with the intention of binding myself, my spouse, heirs and legal representitives, voluntarily and knowingly excuse this Release of Liability in favor of The Ranch at Traders Hill, LLC, their agent and employees.
I acknowledge that riding horses entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death or damage to myself, property or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, among other things: a horse, regardless of its training and usual past behavior, may act unpredictably based upon instinct or fright which may cause me to be thrown from my horse or injured by the horse. Horses may do things such as bite, kick, buck, lie down, or stumble. Saddles may slip and other tack or saddle problems may develop as a result of terrain such as woodlands, tree roots, rocks, bridges, well-traveled roads, wild animals, birds, debris and other obstacles, whether obvious or not and whether man-made or natural. Each of the obstacles or variations in terrain could cause me to lose control of my horse and I could fall. Riding a horse requires me to balance on the saddle. I could lose my balance which could result in falling from the horse.
Furthermore, The Ranch at Traders Hill, LLC seeks safety, but they are not infallible. They may be ignorant of my fitness or abilities, or may misjudge the weather, the elements or terrain. They may give inadequate warnings or instruction and the equipment being used might malfunction, even if it’s in good condition. I am riding a horse today at my own risk, which I voluntarily assume.
In consideration of signing this waiver, I hereby release The Ranch at Traders Hill, LLC and its agents and employees, and others afore named and agree to hold it (them) harmless for any damage, injury or death to person or property, irrespective or how arising, and however caused including but not limited to all kinds and degrees or extent of negligence which The Ranch at Traders Hill, LLC or those others released hereby making or be charged within connection, directly or indirectly with riding or using a horse or stables activity in connection herewith.
It is mandatory for all riders under the age of 18 (minors) to wear headgear for the duration of the show series, which dates beginning the 18th day of March, 2022 and ending the 31st day of December, 2022.
PARENTS OR GUARDIAN ADDITIONAL IDENTIFICATION
All riders under the age of 18 are required to wear protective headgear during the ride. I acknowledge that the Minor has brought headgear, which must be kept on for the entirety of the ride.
In consideration of the above-named minor rider being permitted by The Ranch at Traders Hill, LLC to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless The Ranch at Traders Hill, LLC, its agent, employees and others afore named from any and all claims which are brought by, or on behalf of the minor and which are in any way connected with such use or participation by the minor.
